WIBA {WORK INJURY BENEFITS ACT)

Work Injury Benefits Act (WIBA) is an employee benefit plan enforced by the Kenya law that guarantees your employees get financial compensation when, by accident, they suffer injury, become disabled or die while at work.

This covers employees of the Insured while on duty and engaged in the execution of the Insured’s business against accidental bodily injury, disablement, death or occupational illness. Compensation is payable under the provisions of WIBA Act 2007.

This policy is ideal for all employers, whether employees are permanent or temporary. Casuals as well should be covered. WIBA insurance policy is a mandatory requirement for all employees.

Benefits payable under WIBA policy

  1. Death –Compensation is equivalent to a maximum of 8 Years earnings or 96 Months earning.
  2. Permanent Total Disability – Compensation is equivalent to a maximum of 8 Years earnings or 96 Months earning.
  3. Temporary Total Disability –Compensation is equivalent to weekly earnings up to a maximum of 52 Weeks.
  4. Medical Expense – The policy provides for a free cover limit up to Kshs. 100,000/- per employee. However, the insured may opt for an upper limit.
  5. Funeral/Last expense cover –The policy provides for a free cover limit up to Kshs. 30,00/- per employee. However, the insured may opt for an upper limit.

WIBA does not provide cover for the employee whilst he is not working for the employer. For the employee to be covered while at and out of work, the employer can opt to take an additional group personal accident cover thus WIBA Plus. This extends coverage to 24 hours worldwide.

What’s required?

  • Duly completed and signed proposal form
  • Company certificate of registration
  • PIN certificate for the company
  • Cover limits
  • Names, category/positions and annual salaries of the insured

How to file WIBA claim

  1. Original Dosh 1 forms from ministry of Labour offices.
  2. Original medical bills from the attending hospital.
  3. Medical report signed by the doctor.
  4. Sick off sheets from the employer.
  5. Appointment letter of the claimant by the employer.
  6. Copy of I/D of the claimant.
  7. A report from the insured’s Health and safety committee.
